Abstract
In general, Islam does not set a definitive age limit for marriage, but rather emphasizes the physical and mental maturity of the individual (baligh). Indonesian regulations state that marriage is only allowed if the couple has reached the age of 19. This is in accordance with Law Number 1 of 2019 jo Law Number 16 of 2019. However, there are factors that influence marriage under the specified age, such as: education, economy, culture and family. The number of applications for marriage dispensation at the Magelang Mungkid Religious Court in 2021 was 604 cases, 2022 was 504 cases, and 2023 was 346 cases. In the Magelang Mungkid Religious Court, there was a disparity of marriage dispensation cases with the same applicant in a short period of time in 2023. This research is a type of qualitative research (field research) conducted at the Mungkid Magelang Religious Court using a legal approach, namely legal study research that focuses on the application or implementation of normative legal provisions. This approach is used to explore the legal considerations of a judge in issuing a decision regarding marriage dispensation in cases No.304/PDT.P/2023/PA.MKD and No.331/PDT.P/2023/PA.MKD. This approach also aims to evaluate whether the decision is in accordance with the judicial provisions stated in the Regulation of the Supreme Court of the Republic of Indonesia No.5 of 2019 concerning Guidelines for Adjudicating Marriage Dispensation Applications. The collection of primary data for this research comes from interviews, decision documentation, and Shidarta's theory. Secondary data comes from books, laws and regulations, articles or journals and other documents relevant to the research topic. The results of this study indicate that the Mungkid Religious Court in case No.304/PDT.P/2023/PA.MKD the judge rejected the request for dispensation with material and formal reasoning, while in case No.331/PDT.P/2023/PA.MKD the judge accepted the request for dispensation applying philosophical reasoning. In case No.304/PDT.P/2023/PA.MKD the judge rejected the request for dispensation based on Article 5 and Article 15 of the Regulation of the Supreme Court of the Republic of Indonesia Number 5 of 2019 and in case No.331/PDT.P/2023/PA.MKD the judge accepted the request for dispensation based on Article 2 and Article 16 of the Regulation of the Supreme Court of the Republic of Indonesia Number 5 of 2019.
