Abstract

Since the ratification of the Convention on the Rights of Persons with Disabilities (CRPD) through Law No. 19 of 2011, the rights of persons with disabilities in Indonesia have been increasingly recognized. Two of Indonesia's largest Islamic organizations, Nahdlatul Ulama and Muhammadiyah, have responded in various ways, from legal reasoning (istinbāth) to concrete actions, to promote the rights of persons with disabilities. This study aims to examine the efforts made by Nahdlatul Ulama and Muhammadiyah in promoting the rights of persons with disabilities through a fiqh (Islamic jurisprudence) approach. The findings reveal that: 1) Nahdlatul Ulama has long conducted studies on disability issues, from the Situbondo Congress to the most recent congress, continuously discussing issues related to persons with disabilities in various studies. This has become a mandate that must be implemented through the existing organizational structure within Nahdlatul Ulama, with the Bahtsul Masail Institute serving as a gateway for Nahdlatul Ulama to conduct intensive and in-depth studies, resulting in the development of a Fiqh of Empowerment for Persons with Disabilities from the perspective of the Bahtsul Masail Institute. 2) Muhammadiyah has effectively conducted istinbāth on disability issues through the Majelis Tarjih and Tajdid of the Muhammadiyah Central Leadership, and with its various organizational apparatuses, it has been able to produce a Fiqh of Persons with Disabilities. Starting from its understanding and attention to disability issues, the Majelis Tarjih and Tajdid has continued to improve its studies, which are no longer in the form of preliminary studies but are already in the development process. The results of the national deliberations of the Majelis Tarjih have been socialized to the public and, in particular, to institutions and agencies within the Muhammadiyah environment from the central, regional, district, branch, and sub-branch levels. This socialization is conducted to strengthen Muhammadiyah's social role in social life and to make the best contribution to society in fulfilling the religious rights of persons with disabilities. 3) The istinbāth of Nahdlatul Ulama and Muhammadiyah includes: a) Advocacy for the rights of persons with disabilities conducted by Nahdlatul Ulama and Muhammadiyah. For instance, Muhammadiyah employs a structural and cultural approach in discussing and examining disability issues at the Majelis Tarjih and Tajdid of the Muhammadiyah Central Leadership. Structurally, the Central Leadership of the Majelis Tarjih and Tajdid conducts in-depth studies on issues related to persons with disabilities, resulting in the Fiqh of Persons with Disabilities. This Fiqh of Persons with Disabilities becomes the organization's official policy and serves as a guideline for conducting da'wah (Islamic preaching) of enjoining good and forbidding evil and for empowering the community, especially community-based da'wah, which conducts advocacy and empowerment for persons with disabilities. b) Muhammadiyah's istinbāth on disability issues constructs discourse through various media and means that are institutionally solid and well-organized. Muhammadiyah's commitment to disability issues began with its involvement in community-based da'wah, where it identified several vulnerable groups, including women, children, indigenous peoples, and marginalized groups such as persons with disabilities. Persons with disabilities are considered a vulnerable group that requires attention in the realization of their rights.
