Abstract
Ijarah or capital financing is the provision of short-term or medium-term funds based on sharia principles to assist farmers' businesses in meeting capital needs such as oil palm plantation maintenance, education costs and other needs. Debt payments are made in installments every time the oil palm harvest period arrives. Oil palm farmer is a profession that gets income after the harvest period arrives within a span of 2 times in 1 month. The post-harvest repayment scheme is an alternative solution. However, the number of payments made in stages by farmers does not have an agreement between the two parties, but only the decision of the agent. The purpose of this study is to analyze the practice of ijarah financing between oil palm farmers and agents in Lae Saga Village, Subulussalam City. To find out the answer above, the researcher uses an empirical normative approach with the theory of ijarah, multi-contract and ꜥurf, which theory is related to the research. This type of research isfield research, with primary data in the form of interviews and documentation conducted directly in the field and supported by secondary data such as books, articles and other literature related to the research. The results of this study explain first, the practice of ijarah financing between farmers and palm oil agents in Lae saga Village, Subulussalam City is still carried out until now because in practice the financing system between farmers and agents is mutually beneficial. Farmers get easy access to loans for money and fertilizer, which increases their productivity and income. Meanwhile, agents get the certainty of selling farmers' crops, reducing risks and enabling better marketing planning. This practice creates a sustainable relationship, where both parties benefit. Secondly, the practice of ijarah financing in Lae Saga Village, Subulussalam City combines ijarah and sale and purchase contracts. Farmers apply for capital financing from an agent, who then requires the sale of the harvest to the agent who provides the capital loan. The analysis shows that this practice is 'ꜥurf ṣaḥiḥ, because it has become a stable community custom and does not contradict higher laws. The widespread acceptance by the community as well as the positive impact on social and economic relations support the validity of this ꜥurf, provided it adheres to the principles of Shariah. Legal adjustments that respect local customs further strengthen the status of the ṣaḥiḥ ꜥurf.
