Abstract

Amid the increasing mining activities in Musi Rawas Regency, which impact ecosystem demage, lan degradation, and risk to public health, it is important to examine how the principles of environmental ethics in Islam can guide sustainable mining practices. The focus of this research is to evaluate how the principles of fikih bī’ah can be integrated into mining permits and the conservation of former mining lands in Musi Rawas. This type of research is field research with a juridical-normative approach. The nature of research is descriptive analysis. Data collection is carried out through secondary data, consisting of primary legal materials in the form of environmental protection and management laws and secondary legal materials in the form of legal articles and tertiary legal materials in the form of legal dictionaries and/or other reference notes. The result of the research indicate that the principles of fikih bī’ah in the licensing process in Musi Rawas Regency can be concluded that although the job Creation Law provides a legal basis to expedite the licensing process through the OSS system, the lack of strict implementation and supervision remains a major challeng in achieving a balance between ease of doing business and environmental protection. The principles of fikih bī’ah the reclamation of conservation in Musi Rawas Regency can be concluded that although there are significant efforts to meet the established environmental standards, there is variation in the level of success between large companies and small companies.
