Abstract

The democratic system in Indonesia continues to evolve to ensure better representation of the people. One of the institutions that symbolize regional representation is the Regional Representative Council (DPD). However, until now, the formulation of the Interim Replacement (PAW) for DPD members still faces various challenges, such as a lack of transparency, potential conflicts of interest, and limited public participation in the decision-making process. These weaknesses hinder the effectiveness of the DPD in carrying out its primary function as regional representation. To address this issue, this research examines constituent recall as an alternative, more democratic, fair, and Islamic law-compliant process for PAW. This study employs a normative legal method with a conceptual and regulatory approach. The data sources include primary legal materials, such as the 1945 Constitution, and secondary legal materials gathered from legal literature, academic journals, and regulations. The theoretical framework used includes the theories of popular sovereignty, representation, and maslahah mursalah. This perspective not only evaluates PAW from a legal standpoint but also considers the moral and ethical aspects in accordance with Islamic law. Using a maslahah mursalah-based approach, this research focuses on creating a system that prioritizes public benefit, justice, and public accountability. The research findings indicate that the implementation of constituent recall can provide significant solutions to the weaknesses of the current PAW system. This formulation allows regional citizens to be directly involved in overseeing and evaluating the performance of DPD members, thus giving stronger legitimacy to the PAW process. Furthermore, this approach is in line with the values of justice and public welfare in Islam, which emphasizes the importance of balancing individual and societal interests. Therefore, constituent recall is not only legally relevant but can also strengthen the role of the DPD in Indonesia's democratic system.
