Abstract

The history records that Indonesia was colonized by the Dutch for approximately 350 years, which resulted in legal legacies and similarities in the legal systems of Indonesia and the Netherlands, both of which adhere to democratic principles implemented through legislative bodies. The political system of Indonesia is presidential, while the Netherlands operates under a constitutional monarchy. According to the 1945 Constitution of the Republic of Indonesia, the legislative bodies in Indonesia consist of the People's Consultative Assembly (MPR), the House of Representatives (DPR), and the Regional Representative Council (DPD). In contrast, the legislative framework in the Netherlands, as outlined in the Constitution of The Kingdom of the Netherlands, is executed by the Eerste Kamer (Senate) and Tweede Kamer (House of Representatives). This research employs a normative legal research method characterized by secondary data sources, thus not requiring sampling methods. The research data is obtained through literature review and information gathering from the internet. This study utilizes comparative law theory and legislative theory as analytical tools aimed at forming a conceptual framework for comparative analysis. The findings of this research reveal similarities in the structure of legislative bodies concerning their legislative functions, which consist of two chambers in each parliament, despite differing categorizations. The differences between the parliaments of both countries, based on their respective constitutions, indicate that Indonesia has three legislative bodies (MPR, DPR, and DPD), while the Netherlands has two (Eerste Kamer and Tweede Kamer). Additionally, this study discusses both similarities and differences in the functions and authorities of legislative bodies in accordance with constitutional mandates and legislative processes within each parliament. The research also presents data on public trust levels in the parliaments of Indonesia and the Netherlands, along with compliance indices and democracy indices between these two nations to assess the effectiveness of legislative institutions in exercising their authority.
