Abstract

The discussions about monogamy and polygamy are endless even to this day. Especially, regarding polygamy, examining it from various points of view is very interesting to study, one of which is looking at polygamy from Imam Asy-Syāfi’ī's perspective. The problem formulation of this research is based on the observation of many deviant practices of polygamy that tend toward oppression, and the belief among many people that the original ruling of polygamy is sunnah. In this study, the author examines the views of Imam Asy-Syāfi’ī regarding polygamy and his ijtihād that advocates for monogamy over polygamy, as well as the analysis of Sadd Aż-Żarī’ah concerning Imam Asy-Syāfi’ī's perspective. The purpose of this research is to examine the correlation between Imam Asy-Syāfi’ī's perspective on polygamy and current practices of polygamy. This research includes library research, with a qualitative descriptive research method. The author uses the books written by Imam Asy-Syāfi’ī as primary data sources, as well as several other books as supporting or secondary data sources. In order to understand Imam Asy-Syāfi’ī's views on polygamy, the Sadd Aż-Żarī’ah theory is used as a tool for analysis. The results of this study conclude that according to the view of Imam Asy-Syāfi’ī, monogamous marriage is preferred over polygamy for the reason of being a preventive measure against committing sins due to the inability to treat wives fairly
