Abstract

Government Regulation Number 21 of 2024 concerning the Implementation of Public Housing Savings (PP Tapera) is the latest legal basis for the Tapera programme. The Tapera programme aims to meet the primary needs of the community in the form of livable housing at affordable prices. The Tapera programme is obligatory for all Indonesian citizens who have met the requirements as participants, which consist of workers and self-employed workers with a minimum income of the City Minimum Wage / UMK. Article 15 of PP No. 21 of 2024 explains the amount of contributions that must be paid every month by participants of 3%. However, paragraph (2) explains that the amount of contributions borne by formal workers is only 2.5%, and 0.5% is assisted by the employer or company. This provision is different from independent workers such as gojek drivers who are members of the Yogyakarta Gojek Driver Association (PAGODJA) who must bear the 3% contribution amount themselves. The programme will run in 2027. The purpose of this research is to find out how independent workers respond to PP No. 21 of 2024 concerning Tapera from the analysis of legal sociology and mas}lah{ah mursalah. This research is a descriptive-analytic field study research, namely research conducted with data collection techniques through direct observation, interviews, documentation and literature studies regarding regulations related to Tapera. To answer these problems, this research uses a juridical-sociological approach, so that the data that has been collected is analysed qualitatively. Based on the results of the study, it is stated that the response of independent workers of PAGODJA gojek drivers through the study of legal sociology in terms of social justice found field data as much as 65.8% or 48 out of 73 independent worker respondents who objected to the provision of these contributions. The reason is that the programme does not reflect justice. The injustice lies in the distribution of the contribution burden and the existence of sanctions for workers who are included in the Tapera participant category but do not register until 2027. The programme, which is aimed at low-income people (MBR), actually increases the burden on vulnerable groups including PAGODJA gojek drivers. In the analysis of mas}lah}ah mursalah, the Tapera programme falls into the category of mas}lah}ah ha>jiyyah. This is because the programme aims to minimise difficulties for the community in meeting the needs of the first house. However, this need is not an emergency or urgent need (d}a>ru>riyyah).
