Abstract
Financial Services Authority Regulation (POJK) Number 11 of 2024 concerning the second amendment to Financial Services Authority Regulation 18/POJK.03/2017 concerning Reporting and Requesting Debtor Information Through the Financial Information Service System (SLIK) is the latest regulation that serves as the foundation and guidelines in the implementation of SLIK. POJK on SLIK regulates the use of SLIK, reporting, requests and sanctions that can be imposed on violating parties. Article 1 paragraph (1) states that the Financial Services Authority (OJK) is an independent financial institution with functions, duties, and authorities in regulation, supervision, examination, and investigation. In order to carry out its duties and functions, OJK publishes a system that manages debtor financial data which is then called the Financial Information Service System (SLIK). So that in the implementation process, OJK becomes a regulator and supervisor in reporting activities and information requests through SLIK. Therefore, OJK's functions and duties relating to SLIK are quite central and important for the financial services sector. The purpose of this study is to analyze OJK's objectives in implementing POJK Number 11 of 2024 as well as the implementation of SLIK in the perspective of maṣlaḥah mursalah. This research is a normative legal research (juridical normative) by collecting data through literature study. To answer the existing problems, the authors use a statutory approach and a conceptual approach. To analyze the substance of Article 1 paragraph (1) and (13) of the POJK, and understand the basic concepts underlying the policy. The objective is to assess the suitability of SLIK implementation with existing legal provisions, and focuses on understanding the basic concepts underlying the policy, such as credit information, data accessibility, and its influence on lending decision making. Based on the results of the study, it shows that the implementation of POJK is a preventive measure in minimizing bad debts made by debtors, so that banking and non-banking financial institutions can run the economy, funding and financing in a balanced manner and prevent the swelling of credit rates and improve the performance and growth of financial institutions to run optimally. The enactment of SLIK has fulfilled the conditions and measures of a problem that can be said to be maṣlaḥah mursalah, namely including something that is beneficial, in this case SLIK refers to efforts to protect the wealth of hifz al-mal and protect the soul of hifz al-nasl, fulfills the conditions of qath'y certainty and is at the level of ḍarūriyyah or primary needs.
