Abstract
Land issues are a crucial matter that requires serious attention from the government, considering that land is a vital resource for society. One common example of land issues is land disputes. A land dispute is a problem or disagreement between two or more parties regarding land control, use, or utilization. A case of land dispute that the author found in the Sleman District Court is documented in Decision Number 95/Pdt.G/2023/PN SMN. In this context, the issue arises from the occupation of land by another party, which prevents the rightful owner of the land from utilizing the disputed object, namely a plot of yard land with a building on it, measuring 388 square meters in Wedomartani. This situation has caused Plaintiff, as the rightful owner of the land, to feel aggrieved and to file a report and lawsuit against the other party occupying the disputed object, referred to as Defendant I and Defendant II. This research is a case study using Decision Number 95/Pdt.G/2023/PN SMN as the object of the case study. The normative legal research examines normative legal aspects related to the research object. This descriptive-analytical research will later describe the study in a detailed descriptive manner. Data is collected through literature study and legal document analysis to understand the legal protection provided in Decision Number 95/Pdt.G/2023/PN SMN from the perspective of legal certainty. The theoretical framework used in this research includes the theory of legal certainty, the theory of legal protection, and the theory of justice. The research findings indicate that legal protection for land ownership rights in Decision Number 95/Pdt.G/2023/PN SMN has been applied, demonstrating real legal certainty for parties holding certificates and being able to prove their ownership in court as a result of good faith land registration. In this case, it is closely related to the public registration system of land in Indonesia, which guarantees legal certainty for certificates, as the land registration publication system in Indonesia employs a negative legal system but is moving towards a positive one. This means that ownership of a certificate is considered to have legal certainty, although it is not guaranteed absolutely.
