Abstract

Divorce due to continuous disputes and arguments is one of the main reasons most commonly cited in divorce cases at the Religious Court of Yogyakarta. In an effort to reduce the divorce rate, the Supreme Court issued Circular Letter Number 3 of 2023 to provide new guidelines for judges in handling divorce cases based on continuous disputes and arguments. This Circular Letter mandates the court to conduct mediation in divorce cases, enabling married couples to resolve their disputes without having to divorce. The research method used is field research, employing a normative legal method with a juridical approach. The data sources used are primary data sources, in the form of written documents or findings directly obtained from informants, which include interviews with judges from the Religious Court of Yogyakarta, supported by secondary data sources. Data collection techniques in this study use interviews and documentation. The research findings show that although Circular Letter Number 3 of 2023 is not legally binding like a law, it plays an important role as a guide for judges in handling divorce cases. This Circular Letter also ensures uniformity in rulings by setting a minimum separation period of six (6) months of living apart to confirm that the marriage has failed and reconciliation is not possible. Judges are also required to thoroughly examine evidence, refer to applicable regulations, and ensure that decisions align with the principles of justice. The results also indicate that the implementation of Circular Letter Number 3 of 2023 at the Religious Court of Yogyakarta has had a positive impact on reducing the divorce rate and increasing the awareness of married couples to resolve conflicts through mediation.
