Abstract

Mudarabah term deposits are one of the products at BMT Barokatul Adzkia, Kembangsawit, Kambalan, Kebumen where withdrawals can only be made at certain times based on an agreement on the term to be used with the provisions stated in the BMT certificate. However, there are members who are forced to withdraw their savings before maturity, so members will be charged a penalty fee. The amount of the penalty fee in the mudarabah term deposit certificate is 10% of the amount of the deposit, if withdrawn before the specified period. This problem is what makes the author interested in studying more deeply the practice of penalty fees and the perspective of Islamic law. This study uses a review of Islamic economic law Al - Maslahah Al - Mursalah and Islamic Contract Law. This research is field research, namely research obtained from primary data sources, namely data sources obtained directly from the field. Secondary data sources are data sources obtained from records and books related to the problems that the author is studying. The data collection methods used in this study are documentation, observation, and interview methods, then the data analysis technique used is juridical-normative. Based on the results of the study, the penalty fee taken before maturity at BMT Barokatul Adzkia which is stated in the deposit certificate is indeed justified, but in practice the 10% penalty fee listed is not applied. This is done by considering the provisions of DSN Fatwa No. 03 / DSN-MUI / IV / 2000 Concerning Deposits and also Islamic law which is based on benefits with the analysis of the mursalah problem. The non-application of the 10% penalty fee on the Mudarabah Berjangka Deposit at KSPPS BMT Barokatul Adzkia aims to avoid conflict for the benefit of the community replaced by a replacement from the profit sharing ratio from the month that has run according to the mutual agreement. This is done to avoid BMT liquidity.
