Abstract
Enforcement of laws against the distribution of invasive fish in Yogyakarta is an important issue related to the preservation of aquatic ecosystems and the sustainability of fisheries resources. The distribution of invasive fish in Yogyakarta occurs on a massive scale and presents several challenges. This study aims to analyze the implementation of law enforcement against the distribution of invasive fish in Yogyakarta and to identify the obstacles faced by law enforcement agencies in tackling the spread of invasive fish in the region. Therefore, the author is interested in examining the law enforcement of invasive fish distribution in Yogyakarta. In this study, the author uses the theory of responsive law. This research employs an empirical legal research method, utilizing the theory of responsive law as an analytical tool for law enforcement against the distribution of invasive fish in Yogyakarta. Data were collected from both oral and written sources. Oral sources included interviews with the Regional Marine and Fisheries Office of the Special Region of Yogyakarta, the Animal, Fish, and Plant Quarantine Agency of the Special Region of Yogyakarta, and the Regional Police of the Special Region of Yogyakarta. Written sources included books and journals related to the discussion of this thesis. The results of this study indicate that although regulations governing the distribution of invasive fish exist, such as Ministerial Regulation KP No. 19 of 2020, law enforcement in Yogyakarta still faces various challenges. These include insufficient coordination between agencies, limited human resources and supporting facilities, and a lack of awareness among the public and fishery business operators. Additionally, the law enforcement approach, which remains ultimum remedium (a last resort measure), prioritizes preventive actions that are less effective in preventing the distribution of invasive fish. Therefore, applying Phillip Nonet's theory of responsive law could make law enforcement against invasive fish distribution more effective.
