Abstract
The City of Yogyakarta, as one of Indonesia’s major tourist destinations, faces serious challenges in waste management, including litter scattered on the streets, particularly in tourist areas such as Malioboro, which is always crowded with visitors, as well as an increase in waste volume during various events. Although the Yogyakarta City Government has allocated significant funds for waste management and provided facilities such as temporary disposal sites (TPS), the number of available TPS remains insufficient compared to the volume of waste generated. Furthermore, community efforts in processing and managing waste have not been able to fully resolve this issue. Regulations concerning illegal waste disposal, as stipulated in the Regional Regulation, including the imposition of fines as criminal sanctions, have not been effective in preventing recurring violations. This study aims to analyze the fine-based criminal sanctions in the Regional Regulation on waste management in Yogyakarta City and the implementation of sanctions for illegal waste disposal, with the hope of providing recommendations to enhance the effectiveness of waste management for a cleaner and more sustainable environment. This research employs an empirical juridical method to analyze the enforcement of laws against illegal waste disposal in Yogyakarta City. Using a descriptive-analytical and qualitative approach, the study examines the implementation of fines under the Regional Regulation. Data were collected through interviews, literature studies, and documentation, then analyzed qualitatively using an inductive method. The findings of this study conclude that the enforcement of Regional Regulation No. 10 of 2012 on Waste Management in Yogyakarta City has been carried out through fines, imprisonment, and warnings to violators. However, its implementation has not been optimal, as the sanctions imposed tend to be more lenient than the stipulated provisions, leading to a lack of public compliance with the regulation. In addition to sanctions, the government also provides warnings, education, and advice to violators as part of awareness-raising efforts. Nonetheless, law enforcement faces internal challenges such as limited human resources, as well as external challenges, including low public awareness and insufficient information regarding the importance of waste management. This indicates the need for further efforts to improve the effectiveness of law enforcement and public education to achieve sustainable waste management goals.
