Abstract
The extension of the term of office of village heads as regulated in Law Number 3 of 2024 has raised academic debate regarding its implications for the principles of democracy and the principle of public welfare. As the smallest government entity, villages have a strategic role in maintaining the political and social stability of society. This policy has the potential to provide continuity of development, but also risks inhibiting leadership regeneration and weakening democratic principles, such as participation and accountability in the village head election process. Therefore, this study aims to analyze the extent to which this policy is in line with the principles of democracy and the public welfare of the village. This study uses a qualitative method with a juridical normative approach to explore the complexity of the problem. with the theory of democratic principles and the theory of public welfare, this study not only examines issues related to democracy such as community participation and rotation of power, but also assesses the extent to which the extension of the term of office is able to create stability and efficiency in the implementation of village government. Data were collected through literature studies, including academic literature, documents and legislation. The results of the study indicate that the extension of the term of office can provide opportunities for government stability, budget efficiency, and development continuity. However, there are major risks such as the emergence of authoritarian tendencies, weakening leadership regeneration, and increasing potential for abuse of power due to excessively long terms of office. The analysis also shows that this policy tends to weaken the principle of democracy, which should uphold community participation and accountability in the process of selecting leaders. As an effort to balance the benefits and risks, this study recommends limiting the term of office of village heads in accordance with the principle of rotation of power. Transparent and participatory monitoring mechanisms must also be strengthened to avoid abuse of authority. Thus, policies related to the term of office of village heads can be implemented while maintaining a balance between government stability, sustainable development, and strengthening democracy at the local level.
