Abstract

This puputan tradition is one of the rituals in the birth of a baby. In Islam, the birth of a baby is usually held an aqiqah event. Meanwhile, according to cultural traditions, the tradition of puputan babies using tumbak sewu is held. The purpose of holding the tumbak sewu tradition is as a rejection for babies. This raises the question of whether the tumbak sewu tradition is allowed or not. This study selected Muhammadiyah and Nahdlatul Ulama' Bantul figures because there was no fatwa related to tradition. This thesis uses a qualitative method combined with field research using an empirical juridical approach, data is taken from interviews with three Muhammadiyah leaders and three Nahdlatul Ulama' Bantul figures. Then the data was analyzed using the theory of legal ijtihad. The data used in this thesis is primary data taken directly through interviews and observations. Meanwhile, secondary data is obtained from books, journals, articles and theses. The data analysis technique used is a comparative analysis technique. Based on research and analysis, this study concludes that the leaders of Muhammadiyah Bantul are of the opinion that the law of cultural arts is mubah, because there is an element of sharia that causes this tradition not to be allowed. The opinion of Muhammadiyah leaders uses Irfani's legal approach. Meanwhile, the decision of the Nahdlatul Ulama' Bantul figure to punish can be carried out, but there must be no redundant elements. The intention is only to preserve the culture inherited from ancestors. The opinion of Nahdlatul Ulama' figures uses the Manhaji legal approach, which is taken by the way of thinking and the rules of law determination that have been prepared by the imams of the madhhab.
