Abstract

Marriage in Islam has certain requirements and pillars that must be fulfilled to be considered valid according to religious teachings. However, in Magetan Regency, there is an additional requirement for marriage administration, namely the obligation to plant a tree as regulated in the Magetan Regent Regulation Number 11 of 2020 concerning the Mandatory Tree Planting Movement. This regulation requires prospective brides and grooms to plant a tree before receiving a marriage recommendation from the Village Head or Urban Village Head. Although the intention is to support environmental sustainability, this policy is not outlined in the requirements for marriage under Islamic law or in the positive law applicable in Indonesia. Therefore, this study aims to examine the implementation of this regulation in Magetan Regency, particularly in the Panekan Sub-district Religious Affairs Office (KUA), to determine whether policy implementers are applying this regulation in accordance with the prevailing rules or if they are deviating from them. This study uses a juridical-empirical approach with a descriptive qualitative method. Data were obtained through interviews with marriage registrars, KUA (Religious Affairs Office) officials, and village officials responsible for handling marriage documentation for prospective brides and grooms, as well as through direct field observations of the policy implementation in the Panekan Sub-district. The research findings indicate that the views of marriage registrars and KUA officials regarding this policy are varied. Some view the requirement to plant a tree for prospective brides and grooms as merely an additional regulation, unlike Law No. 1 of 1974 and the Compilation of Islamic Law, which are applicable nationwide. Others see this rule as an added burden for the marriage requirements of the prospective couples. In terms of implementation, it was found that the enforcement of this regulation has not been fully effective due to a lack of good communication between policy implementers, weak disposition among the policy enforcers, and the absence of operational standards as outlined in the Magetan Regent Regulation Number 11 of 2020. Overall, this study concludes that the implementation of Magetan Regent Regulation Number 11 of 2020 in the Panekan Sub-district KUA area has not been fully optimal, as evidenced by the limited number of marriage registration files that include a certificate of tree planting. Additionally, various villages have not fully enforced this regulation strictly or have treated it more as a recommendation rather than a binding rule that must be followed by prospective brides and grooms.
