Abstract

Presidential elections are a fundamental pillar in the constitutional systems of democratic countries. Indonesia and Pakistan, as republics, adopt different systems of government, which significantly influence their presidential election mechanisms. This research is motivated by the need to understand how these differences impact the processes of presidential elections and their implications for democracy and political stability in each country. The study is expected to contribute academically to the understanding of the relationship between presidential election systems and the strengthening of democracy, as well as to serve as an evaluative basis for future electoral reforms. This research employs a normative-comparative method with a constitutional comparison and siyasah dusturiyah approach. Data were collected through literature studies and analyzed descriptively and comparatively. The theoretical framework includes the theory of constitutional comparison, constitutionalism theory, and the principles of siyasah dusturiyah such as shura (consultation), justice, trustworthiness (amanah), and public interest (maslahah). The results show that the presidential election system in Indonesia is conducted directly by the people under a presidential system, while in Pakistan it is carried out indirectly through an electoral college as part of a parliamentary system. Both countries share similarities in the five-year term of office and term limits for the president. However, they differ significantly in terms of the election process and the president's position within the power structure. Overall, Indonesia emphasizes direct public participation, while Pakistan emphasizes institutional representation. These differences affect political legitimacy, governmental stability, and the implementation of democratic and siyasah principles within their respective constitutional systems.
