Abstract

The construction sector is a profession fraught with various risks due to its unique characteristics. To ensure the welfare and protection of workers in the construction services sector, Law Number 13 of 2003 concerning Manpower outlines the rights of workers, one of which is legal protection related to social security rights, mandating that companies/employers register their workers in the BPJS Employment program. PT. Menara Hijau Jaya is a company engaged in construction services, and preliminary research indicates that the company has not included a clause regarding social security in its employment agreement. This research employs an empirical juridical method with a field research approach. The data analysis method used is qualitative analysis. In data collection, the researcher utilized interviews, observations, and documentation. The research findings indicate that PT. Menara Hijau Jaya, which operates in the construction services sector, has not fully implemented legal protection for workers, which is crucial for ensuring the welfare of construction workers in the future. Legal protection was divided into two categories: internal protection for workers, which includes incorporating social security clauses in employment agreements—something that the company has yet to implement. External legal protection consists of regulations governing social security rights that the company must comply. Without legal protection for construction workers, there will be significant risks for workers in the event of workplace accidents and disputes in the future. Workers' legal efforts to obtain social security rights through non-litigation means involve negotiations between worker representatives and the company. The post-COVID-19 factors that complicate job acquisition and the more vulnerable position of workers compared to companies have led workers to accept various job-related risks that loom over them
