Abstract

Decision number 591/Pdt.G/2012/PA.Yk which is a unilateral divorce case with a lawsuit filed by the wife to the Religious Court, there are several things that are not appropriate. In this case, because it started from a feeling of discomfort and incompatibility, it gave rise to several things that ended in an unfair attitude between the parties. Thus, this case is interesting to be re-examined by aligning the rights and obligations between the parties to see the side of justice. This case was then re-examined with the theory of justice brought by John Rawls about fairness and also aligning it with the theory of the realization of family equality so that it can be seen through the side of justice in it. This study uses a qualitative method that refers to data taken through the results of interviews with the parties concerned. All references and data obtained can then help to strengthen the content of the study. By collecting data and other references, it can be seen that there was an unfair attitude between the parties since they were in the household until the divorce process was completed which caused injustice. Poor communication between the two is also one of the reasons for the limited information received by the parties to the case.
