Abstract

Traditional marriage is a series of traditional activities that are passed down from generation to generation and have certain intentions and goals so that the marriage will bring safety and happiness to the family. The implementation of marriage in Javanese customs is closely related to tradition, but traditions or customs in marriage are sometimes not in accordance with the principles of Islam and are contrary to Islamic law. With these problems, the author conducted a study explaining how the implementation of traditions in marriage and how Islam views marriage traditions, especially in Javanese customs. The type of research used is field research which is descriptive analysis, the research approach used is a normative approach. The data sources in this study use primary data sources and secondary data sources. Data collection techniques use interview and documentation methods, data analysis of this study uses qualitative data analysis with inductive methods. The results of the study revealed that there are two conflicting views regarding the tradition as a requirement for marriage. Those who support it view this tradition as a form of preserving the cultural values of ancestral heritage and do not conflict with Islamic law. Those who reject it assume that this tradition has the potential to conflict with the principles of Islamic law and is not in accordance with the development of the times. Analysis of Maslahah Mursalah on the views of the community regarding this tradition, namely the pro view, this tradition has met the requirements for using the maslahah mursalah theory because it covers the needs of the five principles (hifz al-adin, hifz al-nafs, hifz al-aql, hifz an-nasl, hifz al-mal) While the contra view is, maintaining the tradition does not provide clear benefits and does not fulfill the principles of maslahah murslah.
