Abstract

The rapid advancement of technology has made online transactions more prevalent today. One example is online lending and borrowing, or online loans. Online loans make it easier for lenders because they do not have to meet in person and transactions can be carried out anywhere and at any time. One of the organisers of this lending and borrowing model is Kredit Pintar. Kredit Pintar is a peer-to-peer lending application. Peer-to-peer lending is a type of fintech that provides a digital platform to connect borrowers and lenders. However, there is a problem in that the transaction process may not be in accordance with the principles of muamalah. The problem formulations that will be studied in this thesis are therefore: 1) How are muamalah principles implemented in peer to peer lending based smart credit online loans, and 2) What is the legal protection analysis of peer to peer lending online loan protection from the perspective of sharia law. In this thesis, the researcher employs a library research method with a juridical-normative approach. Data was collected through a literature study of written sources from government-owned legal materials, as well as journals and articles. The results of the thesis research report show that online loans from Kredit Pintar, which are based on peer to peer lending, still include several muamalah principles. The transaction activities carried out adhere to the principles of voluntary participation and justice. However, several other principles do not align with Smart Credit's transaction financing model. Additionally, online peer-to-peer lending loans that do not use sharia principles have no sharia legal protection. However, protection from financial institutions, such as the Financial Services Authority (OJK), can be an alternative choice, as they certainly have the authority to implement financial technology (Fintech).
