Abstract
The Law Number 13 of 2003 concerning Manpower Acts regulates provisions to protect the normative rights of women workers. However, the implementation of these regulations is often uneven, particularly in the formal and informal sectors. This research aims to determine how legal protection for women workers, as regulated in Law Number 13 of 2003, is implemented, and to identify the obstacles encountered in its application. This research is an empirical juridical study, which is a field study conducted to obtain information through interviews. Data analysis was carried out using qualitative methods to observe the implementation and obstacles in practice. The theories used in this study are the theory of legal protection, the theory of contract law, and the theory of justice. The research findings indicate that the implementation of legal protection for female workers at PT. BPRS Serambi Mekah has been relatively optimal and in accordance with the applicable regulations. The fulfillment of normative rights such as menstrual leave, maternity leave, social security, and occupational safety is carried out through the support of internal Standard Operating Procedures (SOP) and a strong institutional commitment to the principle of gender equality. In contrast, at Kedai Kopi Liqa, which represents the informal sector, legal protection has not been adequately implemented. The absence of written employment agreements and the reliance on verbal agreements create legal uncertainty regarding workers’ rights. Obstacles in the formal sector include limited supporting facilities such as lactation rooms, insufficient comprehensive understanding of labor regulations, and weak supervision from authorized agencies. Meanwhile, in the informal sector, the main issues include low legal literacy among business actors and workers, the absence of employment contracts, and minimal active involvement from the government in socialization and labor coaching. These conditions demonstrate that although there is a legal framework regulating the protection of female workers, its implementation still faces various challenges, particularly in the informal sector which is less systematically regulated.
