Abstract

The rapid advancement of digital technology, particularly Artificial Intelligence (AI), has significantly transformed various sectors, including the legal and judicial systems in Indonesia. AI is designed to simulate human cognitive functions such as reasoning, analysis, and decision making, offering the potential to enhance efficiency, effectiveness, and speed in law enforcement processes. This study aims to examine the urgency of AI utilization in Indonesia‟s judicial institutions and evaluate its relevance through the lens of maslahah mursalah, an Islamic legal theory that emphasizes public interest and societal benefit. This study is an empirical juridical research aimed at examining the development and effectiveness of technology implementation within the Indonesian judicial system, particularly regarding the digitalization of court processes and the potential application of Artificial Intelligence (AI). Through an empirical juridical approach, the study connects legal norms with actual practices in the field based on interviews, observations, and documentation. Respondents noted that, as of now, there has been no direct implementation of AI technology within the judicial system. However, Indonesia‟s judiciary has undergone extensive digitalization, covering case registration, court proceedings, and appeals submissions all of which can now be conducted electronically. The findings of this study indicate the following:First, the utilization of Artificial Intelligence (AI) in the Indonesian judicial system holds significant urgency, particularly in enhancing the efficiency of judicial institutions. AI plays a crucial role in processing legal information, supporting judicial administration, and providing data driven legal analysis and jurisprudence. Currently, AI in Indonesian law functions solely as a supporting tool and does not yet hold the status of a legal subject. This creates a regulatory gap, especially regarding legal accountability in cases where AI causes harm. Second, from the perspective of Maslahah Mursalah, the application of AI can be considered a form of public benefit (maslahah) as long as it does not conflict with fundamental principles of Islamic law. AI contributes by providing convenience (maslahah hajiyah) and enhancing the quality of legal services (maslahah tahsiniyah). Through the lens of progressive legal theory, the law is expected to continuously adapt to the changing times. AI represents a strategic innovation in the pursuit of justice and equitable access to legal services.
