Abstract

The development of the snack food industry is currently showing a significant increase, including the widespread sale of bulk snacks (camilan kiloan) in Yogyakarta City. However, many of these products are still being sold without halal labels and expiration dates, which has the potential to harm consumers. Labeling on food products is crucial to ensure safety, comfort, and clarity of information for consumers, particularly in the context of both positive law and Islamic law. This raises the issue of how far consumer protection can be enforced in the practice of selling bulk snacks without halal and expiration labels in Yogyakarta. This research is a field study with a juridical-empirical approach using qualitative methods. Data were collected through direct observation, interviews with sellers and consumers of bulk snacks, as well as relevant institutions such as the Food and Drug Monitoring Agency (BBPOM) and the Indonesian Ulema Council's Food, Drug, and Cosmetics Assessment Institute (LPPOM MUI). This study uses the theory of contract to analyze the validity of the sale of unlabelled bulk snacks, the theory of mas{lah{ah mursalah to assess the urgency of consumer protection from an Islamic law perspective, and the theory of consumer protection in positive law as a formal legal basis. The results of the study indicate that: first, most business actors do not understand the importance of including halal and expiry labels. Consumers tend not to be critical of the absence of such information. Second, from a positive legal perspective, this practice is contrary to Law No. 18 of 2012 concerning Food and Law No. 8 of 1999 concerning Consumer Protection. Meanwhile, from an Islamic legal perspective, the practice of selling kiloan snacks without halal and expiry labels in Yogyakarta City based on the mursalah matter is prohibited or not allowed, this is based on 3 reasons: first, the practice violates applicable regulations so that its distribution does not comply with food product standards in Indonesia; second, it is contrary to the principle of protection of life; third, it is contrary to the rules contained in the Qur'an and hadith, namely QS. Al-Maidah: 88, QS. Al-Baqarah: 168, and the hadith of the Prophet SAW regarding the prohibition of endangering oneself and others
