Abstract

Polygamy is a practice of a man marrying more than one woman which until now still continues to be debated in various aspects of life including law, social, cultural, and religious. In the Indonesian context, polygamy is regulated by Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law, which stipulates strict conditions for its implementation. However, in practice, many cases of polygamy are carried out without complying with these provisions, which has the potential to cause injustice to the wives involved. The film Surga yang Tak Dirindukan 1 depicts this reality by highlighting the emotional and legal conflicts experienced by its main characters. This study aims to analyze the representation of the fulfillment of wives' rights in polygamous marriages through the perspective of positive law and Islamic law, and to explore the challenges faced by women in this context. This research is descriptive-analytical with qualitative methods. Data were collected through a literature study involving the analysis of the film Surga yang Tak Dirindukan 1 as a primary data source, as well as related literature such as books, journals, and laws that discuss polygamy and the rights of wives in the context of positive Indonesian law and Islamic law. The normative-philosophical approach is used to analyze the perspectives of positive law and Islamic law related to the representation of the fulfillment of wives' rights in polygamous marriages in the film Surga yang Tak Dirindukan 1, especially using the normative theory of positive law in Indonesia, John Rawls' theory of justice, the normative theory of Islamic law, and the thoughts of Muhammad Abduh. The results of the study show that the film Surga yang Tak Dirindukan 1 depicts a violation of positive legal provisions and Islamic legal principles regarding polygamy. Pras's action without fulfilling the stipulated requirements creates significant injustice towards women. In addition, Muhammad Abduh's criticism of polygamy practices that are not based on justice and women's emancipation further emphasizes that polygamy carried out without fulfilling these principles can lead to oppression. This study highlights the importance of a deeper understanding of polygamy regulations and the protection of women's rights in the context of law and morality.
