Abstract
This research is entitled "Sharia Economic Law Analysis of Bitcoin Transactions from the Perspective of Maslahah Mursalah." The background of this study lies in the increasing use of Bitcoin and other digital assets amidst the rapid development of global financial technology. This phenomenon has sparked both support and opposition, especially from an Islamic perspective, due to the absence of clear regulations and the potential presence of speculative elements, gharar (uncertainty), and riba (usury) in its transactional practices. Therefore, this study is important in examining the legitimacy of Bitcoin transactions within the framework of Sharia economic law, particularly through the lens of maslahah mursalah.This is a normative-juridical research using a qualitative approach. Data were collected through interviews with several informants experienced in using Bitcoin, as well as literature reviews of relevant sources. The data are classified into primary and secondary sources. The analytical technique employed is descriptive-analytical, with a focus on the interpretation of Islamic law and the relevance of the maslahah mursalah principle in the context of digital transactions. The findings indicate that Bitcoin transactions may be considered permissible under Sharia law if they meet certain conditions, such as transparency, productive use (e.g., for legal investment and trade), and the absence of maysir (gambling), gharar (ambiguity), and riba. The principle of maslahah mursalah serves as the basis for legal justification, provided that the transaction brings benefit (maslahah) and does not contradict the objectives of Islamic law (maqashid al-shari’ah). However, in practice, Bitcoin transactions still face regulatory challenges and the risk of misuse, highlighting the need for clear legal policies and public education on its risks and ethical usage.
