Abstract

The phenomenon of increasing numbers of parents becoming migrant workers in Karangpetir Village, Tambak District, Banyumas Regency has given rise to new dynamics in child-rearing patterns. This has triggered a shift in child-rearing patterns from parents to grandparents (grandparenting). This shift often occurs due to parents' busy work schedules and family economic pressures, but in the long term, it has the potential to lead to the phenomenon of fatherless, where children lose the emotional presence of a father figure. This parenting pattern presents its own challenges due to differences in values, experiences, and age between grandparents and children, which can influence the child's character development. This issue is also related to the concept of ḥaḍānah in Islamic law, which emphasizes the obligation to provide comprehensive care and protection for children to meet their physical, spiritual, and moral needs. Therefore, this study focuses on analyzing grandparenting practices in migrant worker families and how the maṣlaḥah perspective assesses the transition of parenting roles from parents to grandparents. This study uses a qualitative method with an empirical legal approach, which aims to describe the maṣlaḥah perspective on the transition of parenting patterns from parents to grandparents in migrant worker families in Karangpetir Village, Tambak District, Banyumas Regency. Primary data sources were obtained through interviews with children affected by grandparenting and grandparents who practice grandparenting. Secondary data sources were obtained from various written sources, including theories relevant to this study. Data analysis was conducted using the Miles and Huberman model through the stages of reduction, presentation, and conclusion drawing. The research findings indicate that children of migrant workers face multidimensional issues due to the absence of their parents, particularly their fathers. The impacts of this situation include emotional disturbances such as loneliness, jealousy, loss of an authoritative figure, and weak moral and spiritual guidance. This phenomenon can be categorized as fatherless, which indicates the non-fulfillment of the ḥaḍānah requirement in fiqh, the Compilation of Islamic Law (KHI), and the Child Protection Law. From the perspective of maṣlaḥah according to al-Ṭūfī, the involvement of grandparents falls under the category of maṣlaḥah ḍarūriyyah, as it pertains to urgent needs in child protection. The practice of grandparenting also falls under the category of maṣlaḥah that is of a muamalah nature. The role of grandparents can also be understood as a form of implementing ḥaḍānah in fiqh, as it fulfills aspects of protection, care, and education. Their role contributes to ḥifẓ al-dīn (preserving religion), ḥifẓ al-nafs (preserving the soul), ḥifẓ al-‘aql (preserving the mind), ḥifẓ al-nasl (preserving offspring), and ḥifẓ al-mal (preserving wealth).
