Abstract

This research is motivated by the need of the Muslim community to obtain legal certainty regarding the purification of mughallazah impurities, particularly through the use of thaharah soap as an alternative material for purification of mughallazah impurities that has developed in the modern era. This is increasingly important with the presence of a fatwa from the Pejabat Mufti Wilayah Persekutuan Malaysia which specifically permits the use of thaharah soap as a means of purification of mughallazah impurities. The existence of this fatwa demonstrates a contemporary legal response to the needs of the community, while also opening up space for academic discussion regarding the comparison of the views of classical scholars with modern legal products. The method used in this study was qualitative, using a library research approach. Data sources were obtained from classical fiqh books, books, scientific journals, official fatwas from the Pejabat Mufti Wilayah Persekutuan Malaysia, and other relevant literature. Data analysis was conducted using a descriptive-comparative method, systematically describing the opinions of scholars and the contents of fatwas, then comparing them to identify similarities and differences. The results of the study indicate that Imam Abu Hanifah permitted the use of soap or other materials that can remove impurity, while Imam Ahmad bin Hanbal stipulated that it must be purified with water seven times, one of which was with soil, according to the Prophet's hadith. Meanwhile, the fatwa of the Pejabat Mufti Wilayah Persekutuan Malaysia is in line with Imam Abu Hanifah's view, namely permitting the use of thaharah soap as long as it can remove impurity. Thus, this study found two main approaches: a textual approach as Imam Ahmad bin Hanbal, and a more flexible contextual approach as seen by Imam Abu Hanifah and contemporary fatwas in Malaysia. Although there are differences in the application of the legal details, both aim to ensure that during purification of impurity Mughalladzah carried out in accordance with the principles.
