Abstract

The Sleman Regency Government has enacted regulations regarding Smoke Free Zones (KTR) in Regent Regulation (Peraturan Bupati) Sleman Number 42 Year 2012. This regulation specifies the areas where smoking activities are prohibited, including: Health Service Facilities, Teaching and Learning Process Areas, Children's Playgrounds, Places of Worship, Public Transportation, Workplaces, and Public Places. A "teaching and learning process area" is defined as a building used for learning, teaching, education, and/or training activities. In this context, the Faculty of Sharia and Law (FSH) at Sunan Kalijaga State Islamic University (UIN) Yogyakarta falls under this category. However, based on observations conducted by the author in the field at the Faculty of Sharia and Law, many students were still found smoking within the faculty environment, such as in front of classrooms, in faculty corridors, faculty gardens, and on faculty staircases. This study is a qualitative research using a field research method, characterized as descriptive analytical. Its objective is to examine the implementation of Sleman Regent Regulation No. 42 concerning Smoke Free Zones at the Faculty of Sharia and Law, UIN Sunan Kalijaga Yogyakarta. The research employs a juridical empirical approach: the juridical aspect examines normative concepts or legal regulations, while the empirical aspect investigates the realities in the field. The theories used are policy implementation theory and maslahah mursalah theory. Data were collected through interviews, observation, and documentation, and then systematically analyzed to draw conclusions. The research findings indicate that the implementation of Sleman Regent Regulation Number 42 Year 2012 concerning KTR at the Faculty of Sharia and Law, Sunan Kalijaga State Islamic University Yogyakarta, has not been effective. This ineffectiveness is attributed to various factors, including communication, availability of resources, disposition (attitudes), and a bureaucratic structure that is not formally supportive. Based on its quality and importance, this KTR policy is categorized as maslahah daruriyah, as it encompasses the protection of fundamental aspects of human life, such as the safety of life and property, which are essential for societal well being.
