Abstract
The prospective hajj pilgrims has continued to increase each year, whereas the hajj quota allocated by the Government of Saudi Arabia remains limited. Consequently, a long waiting list for hajj departures has emerged. Alongside the growing number of prospective pilgrims and the lengthening queue, the accumulation of hajj funds has also significantly increased. As of 2024, the total accumulated hajj funds amounted to approximately 171 trillion Rupiah. The Hajj Financial Management Agency (BPKH), as the institution mandated to manage these funds, is required to invest them in order to achieve optimal returns in accordance with Sharia principles. In terms of investment, particularly in the national infrastructure sector, BPKH faces the challenge of public controversy regarding the use of hajj funds to finance infrastructure projects. This study examines the challenges in managing and investing hajj funds by BPKH. The study employs a literature review method and is analyzed qualitatively and descriptively through a juridical-normative approach. The findings indicate two major challenges. First, the debate surrounding the investment of hajj funds in national infrastructure is largely triggered by a lack of public trust in the transparency and accountability of government projects. Second, the fatwa issued by the Indonesian Ulema Council (MUI), which prohibits the use of returns from hajj fund investments to finance the implementation of the hajj pilgrimage, has created a normative and practical dilemma. BPKH has responded to public distrust regarding infrastructure investments by emphasizing that all fund placements are conducted with prudence, transparency, and strict risk assessment as well as Sharia compliance, in order to ensure the safety and welfare of pilgrims’ funds. Meanwhile, BPKH addressed the MUI fatwa through dialogue with the MUI, resulting in a Memorandum of Understanding (MoU) between the two institutions to strengthen governance of hajj fund management. This development was further reinforced by the Ministry of Religious Affairs during the 2024 Hajj Symposium (Mudzakarah Perhajian), which concluded that the use of returns from hajj fund investments to finance the pilgrimage is permissible.
