Abstract
Domestic Violence (KDRT) is a criminal offense regulated under Law Number 23 of 2004, with the primary aim of protecting victims and prosecuting offenders. At the Yogyakarta City Police (Polresta Yogyakarta), some domestic violence cases are resolved through a Restorative Justice (RJ) approach in accordance with Indonesian National Police Regulation Number 8 of 2021. Restorative Justice emphasizes restoring relationships and fulfilling victims’ rights through peaceful settlement agreements. However, a peaceful settlement does not always guarantee the victim’s safety, making it necessary to evaluate the effectiveness of fulfilling these rights. This study aims to describe the mechanism for fulfilling victims’ rights in domestic violence cases through Restorative Justice at Polresta Yogyakarta and to analyze its effectiveness based on Gustav Radbruch’s Theory of Law Enforcement justice, expediency, and legal certainty as well as Maqāṣid Syarī‘ah. This is a field research using an empirical juridical approach with a descriptive qualitative method. Data were collected through interviews with investigators from the Women and Children Protection Unit, observations, and documentation. The findings indicate that the fulfillment of victims’ rights through Restorative Justice at Polresta Yogyakarta includes material compensation, psychological recovery, and safety guarantees. Procedurally, the implementation of Restorative Justice is in line with Perpol No. 8 of 2021. However, challenges remain, including disproportionate compensation amounts, the lack of consistent monitoring of agreement implementation, and some victims continuing to feel threatened after the settlement. From Radbruch’s theoretical perspective, the element of legal certainty is relatively fulfilled due to formal documentation, expediency is achieved in cases that successfully restore family relations, yet justice remains suboptimal for victims who do not receive ongoing protection. This research recommends strengthening post Restorative Justice monitoring mechanisms and increasing the role of victim advocates to ensure sustained safety.
