Abstract

Elections are the primary instrument for the people to realize direct, free, confidential, honest, and fair democracy. However, the implementation of the 2024 elections has revealed serious challenges related to violations of the neutrality of state officials. This neutrality includes the obligation for every public official not to use their position, authority, or state facilities to support certain election participants. Many state officials, both at the central and regional levels, are suspected of engaging in political partisanship, either explicitly or implicitly. Such actions not only violate legal regulations, particularly Law No. 7 of 2017 on General Elections, but also undermine the principle of equality among election participants and interfere with the public's freedom to make political choices. This phenomenon raises serious concerns about the quality of electoral democracy in Indonesia and underscores the need for a thorough legal review to analyze the impacts and identify relevant solutions. This study uses library research methods with a legal-normative approach. This study uses primary and secondary legal materials in the data collection process to gain a deep and comprehensive understanding of the neutrality of state officials in the 2024 elections. The analysis will use a combination of electoral democracy theory and Islamic leadership principles as the analytical framework and theoretical foundation for this study. The research findings indicate that the neutrality of state officials in the 2024 elections has a significant impact on the quality of electoral democracy, leading to disparities in competition among election participants, a decline in public trust, and distortions in public political preferences. From an Islamic leadership perspective, this is inconsistent with the principles of trustworthiness, justice, and responsibility in Islamic leadership. Islam requires a leader to act fairly and not abuse power, and the lack of neutrality among government officials threatens the preservation of life (hifdz nafs) and property (hifdz mal). When neutrality is violated, it is not only the law that is undermined but also the fundamental values of Islamic leadership rooted in the Quran and Hadith.
