Abstract
Following the Reformation era, regional governments were granted autonomous authority to manage their own administrative affairs. However, this decentralization has led to the emergence of various regional legal products, some of which have proven to be problematic. One such example is Regional Regulation of Maros Regency No. 16 of 2005 concerning Muslim and Muslimah Attire. This regulation, which carries religious overtones, should fall under the jurisdiction of the central government, as stipulated in Article 10 paragraph (1) point (f) of Law No. 23 of 2014 on Regional Government. From the perspective of the hierarchy of legislation, this regulation is subject to debate, as its content is considered to contradict higher legal norms. In terms of legal effectiveness, the regulation lacks clear enforcement mechanisms and firm sanctions. This study examines three main issues: first, the position of Regional Regulation No. 16 of 2005 within the hierarchy of statutory regulations; second, the effectiveness of the regulation based on Lawrence M. Friedman’s legal system theory; and third, an analysis of the regulation from the perspective of Siyasah Tasyri’iyyah. This study employs a normative-empirical legal research approach, utilizing both field research and literature review with an empirical juridical method. The data sources consist of primary and secondary legal materials. The data are then analyzed and conclusions are drawn using a deductive reasoning process, moving from specific findings to general conclusions. The findings of this study indicate that Regional Regulation No. 16 of 2005 concerning Muslim and Muslimah Attire in Maros Regency, South Sulawesi Province, presents numerous issues. First, the regulation contradicts the 1945 Constitution and the Law on Regional Government, as it regulates religious matters that fall under the exclusive authority of the central government. From the perspective of the hierarchy of legislation, the regulation is also problematic as it contains discriminatory elements and is inconsistent with the principle of non-discrimination upheld in higher legal norms. Second, based on Lawrence M. Friedman’s legal system theory and Soerjono Soekanto’s theory of legal effectiveness, this regulation is ineffective due to its weak implementation and lack of support from local cultural values. Third, from the perspective of Al-Mawardi’s Siyasah Tasyri’iyyah, although the regulation aims to uphold Islamic values, it fails to realize public welfare (maslahah), meaningful public participation, and substantive justice within the framework of Islamic law. Instead, the regulation functions more as a symbolic expression of identity than as a fair and effective legal instrument.
