Abstract

This study examines the application of Sharia principles, specifically Sadd al-Zari‘ah (Islamic law) in the export practices of non-BPOM food, cosmetic, and herbal products in Indonesia. In the context of globalization, consumers are increasingly demanding products that are not only halal but also tayib (good, quality, safe, and beneficial). Non-BPOM products encompass a wide range of goods that are often not registered with the Food and Drug Monitoring Agency (BPOM), putting them at risk of facing regulatory challenges in export destination countries. This study explores the factors driving international trade in Indonesia and how businesses, particularly micro, small, and medium enterprises (MSMEs), must adapt to increasingly stringent standards. Using a normative juridical approach, this study identifies various challenges faced by businesses in meeting export requirements, including compliance with regulations and halal certification. The application of Sharia principles can increase the competitiveness of Indonesian halal products in the international market, particularly in markets with a predominantly Muslim population. This study also assesses the impact of regulations, such as Minister of Trade Regulation No. 23 of 2023, on the smooth transaction process and compliance with Sharia principles in Sharia business. The research results show that Sadd al-Żarī‘ah plays a crucial role in preventing harm that can occur due to the export of products that do not meet safety and quality standards. Recommendations are given for the government and relevant institutions to increase collaboration in providing support to business actors in terms of certification and standard compliance. Thus, the integration of Sharia principles into export practices is expected to encourage sustainable and equitable economic growth and protect consumers from the risks of unsafe products.
