Abstract

The high divorce rate in Sleman Regency highlights the importance of mediation as a means of peaceful dispute resolution. Data indicate that the number of divorce cases at the Sleman Religious Court decreased in 2023 compared to 2022, with a relatively higher success rate in mediation. This study aims to analyze the role of mediators in influencing the success of divorce mediation, the effectiveness factors that support it, and the obstacles encountered. This research employs a qualitative method with a juridical-empirical approach. Data were collected through interviews with mediators and court officials at the Sleman Religious Court, supported by documentation and literature review. The analysis uses Soerjono Soekanto’s theory of legal effectiveness. The findings show that the effectiveness of divorce mediation is determined by three main factors: (1) the legal factor, namely the enactment of Supreme Court Regulation (PERMA) No. 3 of 2022 which updates PERMA No. 1 of 2016 and provides easier access to conduct online mediation; (2) the mediator factor, as the key to success by applying the caucus strategy to understand the psychological conditions of the parties and emphasize religious and cultural values; and (3) the facilities factor, including mediation rooms and electronic court support. The main obstacle comes from the societal factor, particularly low legal awareness and the firm intention of the parties to divorce. Nevertheless, mediators remain the decisive element in achieving successful mediation.
