Abstract
Determination of compensation value in land acquisition for the construction of the Jogja-Solo Toll Road, especially in the Ringinsari, Maguwoharjo area, has caused various problems in the field. Many residents feel that the compensation value determined by the appraisal team does not reflect the real value of the land and buildings even though the deliberation and review process has been carried out. The discrepancy between community expectations and the assessment results has caused objections that have led to conflict and legal efforts. This study aims to analyze whether the calculation and determina-tion of the compensation value are in accordance with applicable regulations and how efforts to resolve the compensation value are made by the related parties. This research is a qualitative research with an empirical legal approach. Empirical legal research is used to examine the implementation of normative legal provisions in practice, especially related to the determination of compen-sation values in land acquisition for toll road construction. This research uses field research to collect primary data through interviews with the BPN DIY Regional Office, the Appraisal Team and communities affected by land acquisition. This research also examines relevant legal regulations as a basis for normative analysis. This research is analyzed using the welfare state theory and the theory of legal certainty to provide a comprehensive picture of the protection of the rights of communities affected by land acquisition. This study concludes several things, first the calculation of the compensation value for land acquisition for the Riginsari Toll Road, has been in accordance with applicable regulations. Second, efforts to resolve the compensation value for errors in initial data collection, especially buildings that have not been recorded, are re-verified by the appraisal team, as well as various settlement mechanisms that refer to applicable legal provisions, namely deliberation, objections, mediation and legal channels.
