Abstract
This study aims to analyze the effectiveness of the maladministration complaint resolution mechanism implemented by the Ombudsman Institution of the Special Region of Yogyakarta. One of the authorities of the ombudsman is to receive reports/complaints from the public regarding maladministration practices and to follow up on such reports in order to achieve justice for all citizens. However, a considerable number of complaints remain unresolved and continue to accumulate. Therefore, the research problems are formulated as follows: how effective is the maladministration complaint resolution mechanism of the Ombudsman Institution of the Special Region of Yogyakarta? How is the supervisory system of the Ombudsman Institution of the Special Region of Yogyakarta viewed from the perspective of Maqasid al-Shari’ah? To address these problems, the research employs an empirical juridical approach, namely legal research based on field facts. Data were obtained through documentation studies and interviews with commissioners of the Ombudsman Institution of the Special Region of Yogyakarta. All collected data were then analyzed qualitatively. The findings indicate that the complaint resolution mechanism of the Ombudsman Institution of the Special Region of Yogyakarta has not been fully effective, as clarification, coordination, investigation, and mediation processes require a considerable amount of time. Nonetheless, public service supervision carried out by the Ombudsman Institution of the Special Region of Yogyakarta is in line with the principles of good governance, such as the rule of law, accountability, transparency, and fairness. Furthermore, the objectives of supervision conducted by the Ombudsman Institution share similarities with the goals of Maqasid al-Shari’ah, namely that public policies must be based on legal principles as the primary source of the legal hierarchy. In addition to focusing on the realization of societal welfare, policy formulation must also remain consistent with prevailing legal provisions.
