Abstract

This thesis is entitled "Fulfillment of the Political Rights of Persons with Disabilities in the 2024 General Election in Kenjeran District, Surabaya (Perspective of al-Huquq al-Insaniyah)." This research is motivated by the importance of guaranteeing the political rights of all citizens without discrimination, including persons with disabilities. Based on data from the Surabaya City Social Service in 2024, the number of persons with disabilities in Kenjeran District was recorded at 458, with various disabilities including physical, blind, deaf-mute, intellectual, and multiple. This number is quite high in the coastal area of Surabaya, making the urgency of providing political rights significant to study. This research uses a qualitative method with a juridical-sociological approach. Data were obtained through interviews with the Surabaya City General Elections Commission (KPU), the Kenjeran District Election Committee (PPK), and persons with disabilities as respondents. Furthermore, the researcher also reviewed legal documents, regulations, and the concept of al-huquq al-insaniyah as a theoretical basis. The research results show that, normatively, the political rights of persons with disabilities are guaranteed by the constitution and laws and regulations, and efforts have been made to ensure their protection through the provision of accessible polling stations (TPS), special assistance, and wheelchair ramps. However, in practice, obstacles remain in Kenjeran District, such as the limited number of disability-friendly polling stations (TPS), minimal inclusive political outreach, and insufficient training of polling station (KPPS) staff in serving voters with disabilities. This situation demonstrates the urgency in Kenjeran to ensure election inclusivity is truly implemented, given the high number of persons with disabilities who are vulnerable to losing their right to vote if accessibility is not met. From the perspective of al-huquq al-insaniyah (justice), preserving the political rights of persons with disabilities is part of human rights, grounded in the values of al-musawah (equality) and al-'adl (justice). This principle affirms the state's obligation not only to recognize the political rights of persons with disabilities but also to provide facilities that enable them to exercise their right to vote fully, equally, and competently.
