Abstract

Indonesia as an archipelagic country has a larger sea area than land, with 17,508 islands and a coastline of 81,000 km. The wealth of marine natural resources includes; fisheries, mangrove forests, coral reefs, and mining materials. Article 33 paragraph (3) of the 1945 Constitution states that "natural resources are controlled by the state for the prosperity of the people. However, exploitation of resources such as sea sand mining has a serious impact on the environment. Law No. 32 of 2009 regulates environmental protection, but obstacles in implementation and law enforcement still exist. The export of sea sand was temporarily suspended through the Decree of the Minister of Maritime Affairs and Fisheries in 2003, but was allowed again through PP No. 26 of 2023 which caused controversy regarding ecological impacts and human rights. This study uses a normative legal approach which examines the Laws and Regulations and legal principles relevant to the problem being studied. This study aims to analyze whether Government Regulation No. 26 of 2023 concerning the Export of Sea Sand is contrary to Islamic values or not by using the concept of maslahah mursalah as an analytical tool and also this study is to examine the legal aspects of sea sand exports based on Article 9 paragraph (2) letter D of PP No. 26 of 2023 and this study shows that PP No. 26 of 2023 Article 9 paragraph (2) needs to be reviewed and even canceled because the impact caused by sand exports is very clear and has occurred in Indonesia before.
