Abstract
The public's need for halal product guarantees is increasing, especially for Muslims who are required to consume halal (QS. Al-Baqarah: 168). The government responded through Law No. 33 of 2014 and Government Regulation No. 42 of 2024 as the latest implementing regulations, with BPJPH as the organizer through the SEHATI program. This research analyzes the effectiveness of PP No. 42/2024 with a case study on the Halal Center UIN Sunan Kalijaga as LP3H in assisting free halal certification for MSEs in Yogyakarta. This research uses a qualitative method with a juridical-empirical approach that is descriptive-analytical in nature. Data were collected through observation, interviews, and documentation at the Halal Center UIN Sunan Kalijaga Yogyakarta as the research location. The juridical approach is used to examine the legal provisions governing the implementation of halal certification, especially Government Regulation Number 42 of 2024, while the empirical approach is used to understand its implementation in the field. Data analysis is carried out descriptively-qualitatively through the process of data reduction, thematic data presentation, and conclusion drawing by referring to the theory of legal effectiveness and the concept of halal product guarantee. The findings of this study indicate that Government Regulation Number 42 of 2024 has been quite effective in implementing the free halal certification program for MSEs in Yogyakarta, especially through the assistance mechanism organized by the Halal Center UIN Sunan Kalijaga. When viewed through the five factors of legal effectiveness according to Soerjono Soekanto, it can be seen that the legal substance aspect has been supported by adequate regulations and can be well understood by the implementing actors. BPJPH as a law enforcer shows constructive performance in the regulative and coaching aspects. Supporting facilities, such as the availability of quotas and PPH assistants, are sufficient even though the SIHALAL system still encounters technical problems. Community participation of MSE actors is high with increased awareness post-socialization, while local cultural factors also strengthen acceptance of this regulation through deep-rooted religious values. On the other hand, the success of this program is supported by three main elements: the internal quality of the Halal Center in fostering assistants, collaborative support from various stakeholders, and active involvement of assistants in the field. However, challenges remain, including system disruptions, regulatory dynamics, and geographical barriers that make mobility and access to information difficult.
