Abstract

Agriculture plays a crucial role in the development of a nation. But ironically, This sector is still closely related to the problem of poverty. To overcome this, concrete efforts are needed from the government to empower the agricultural sector. One of the efforts made is providing subsidized fertilizer assistance, and monitoring the allocation of fertilizer to ensure its availability in the field. Through Minister of Agriculture Regulation No. 1 of 2024, the government has established allocation procedures and the highest retail price (HET) for subsidized fertilizers. However, in Cikedal District, the distribution of subsidized fertilizer has not been felt evenly by farmers. This is certainly detrimental and violates the rights of farmers. Therefore, researchers are interested in studying this phenomenon in more depth. This research is a normative-empirical research, with a live case study approach, a method for analyzing ongoing or unfinished events. Consists of two types of data sources, namely primary data and secondary data. Then the data collection technique was carried out through observation, interviews and documentation. This research uses Soerjono Soekanto's theoretical framework of Legal Effectiveness, which includes five factors: the law itself, law enforcers, means and facilities, society, and culture. This theory helps understand the importance of clear, complete and detailed regulations. In addition, Jasser Auda's Maqāşid asy-Syarī'ah theory is also used, which emphasizes the growth, progress, and protection of human rights within the scope of individuals, society, and the state. The results of the study show that Permentan No. 1 of 2024, when viewed from Soerjono Soekanto's theory of Legal Effectiveness, can be said to be ineffective. This is evident from the Minister of Agriculture's focus on revising previous regulations, as well as the overlapping performance of law enforcement, which is detrimental to farmers as beneficiaries of subsidized fertilizer. In addition, the low quality of farmer human resources and the less than optimal performance of PPL further worsen the situation. However, this Statement has a positive aim for the welfare of Indonesian farmers, which is in line with Jasser Auda's theory of Maqāşid asy-Syarī'ah. However, its implementation in Cikedal District still faces a number of obstacles that need to be fixed.
