Abstract
The merit system and the principles of good governance are fundamental pillars in the appointment of State Civil Apparatus (ASN) positions to establish a professional bureaucracy free from political interference. However, with the enactment of Law No. 20 of 2023, members of the Indonesian National Armed Forces (TNI) and the National Police (POLRI) are now permitted to hold ASN positions without undergoing a strict meritocratic selection process. This raises concerns about ASN neutrality and the potential increase of military influence in civilian governance, which contradicts democratic principles and bureaucratic reform efforts. This study employs normative legal research with a statutory approach. The theories used as analytical tools include the merit system, good governance, and maslahah mursalah. Data was obtained through a literature review of relevant laws, academic journals, and related documents. A descriptive-qualitative analysis was conducted to evaluate the impact of this policy on governance and bureaucratic effectiveness. The findings indicate that this policy has the potential to hinder the merit system, threaten accountability and transparency in ASN management, and create opportunities for conflicts of interest and abuse of power. From the perspective of maslahah mursalah, the policy brings more harm than benefit, as it weakens ASN professionalism and blurs the distinction between the military and civilian sectors. Therefore, additional regulations are needed to ensure that ASN appointments remain aligned with meritocratic principles and sound governance practices.
