Abstract
This study examines the role of non-judge mediators at the Yogyakarta Religious Court in handling divorce cases affected by silent treatment during 2023–2024. Silent treatment is a form of emotional abuse characterized by deliberate silence, which undermines marital harmony and may lead to divorce. Although not explicitly regulated in Indonesian positive law, this behavior can be categorized as psychological violence under Law No. 23 of 2004 on the Elimination of Domestic Violence. The research employs a qualitative method with normative and sociological approaches, using interviews with non-judge mediators, observations, and documentation of divorce case data at the Yogyakarta Religious Court. The analysis is based on Bruce J. Cohen’s role theory and the Islamic concept of Iṣlāḥ to assess how mediators fulfill their mediation functions in the context of communication breakdowns. The findings reveal that mediators have carried out their enacted roles by listening to both parties’ grievances, applying strategies such as caucus, encouraging open dialogue, and emphasizing emotional connection. Mediators also serve as role models by demonstrating healthy communication and maintaining neutrality. However, limitations remain, as mediation often fails when couples are firmly determined to divorce. From the perspective of Iṣlāḥ, mediators strive to implement principles of improvement, reconciliation, and deliberation, although the outcomes frequently focus on post-divorce arrangements such as child custody and alimony. In conclusion, while the success rate of mediation in preventing divorce remains low, mediators still play a crucial role in ensuring that divorce proceedings are conducted peacefully and with dignity. This study recommends that the Religious Court establish specific guidelines or SOPs for mediators in handling silent treatment cases and provide specialized training in family psychology to enhance mediation effectiveness.
