Abstract
The increasing prevalence of ex international iPhone sales in Indonesia has led to various legal and consumer issues, particularly regarding price discrepancies and the lack of transparency in warranty implementation. This study aims to analyze the forms of legal protection for consumers and the responsibilities of business actors in ex- inter iPhone transactions at iPhone Semarang 2013, based on the provisions of Law Number 8 of 1999 concerning Consumer Protection. This research employs an empirical juridical method with a qualitative descriptive approach, combining a normative review of legislation with empirical data obtained through interviews and observations of business actors and consumers. The analysis is grounded in consumer protection theory and liability theory, focusing on the implementation of the principle of good faith and the compliance of business actors with the Consumer Protection Law (UUPK). The research problems are: (1) What types of consumer losses are experienced by users of ex-international iPhones regarding pricing and warranty at iPhone Semarang? (2) How is the responsibility of business actors toward consumers purchasing ex international iPhones at iPhone Semarang? The findings show that legal protection for consumers of ex international iPhones has not been effectively implemented, as business actors continue to violate Article 4(c) and Article 10 of the Consumer Protection Law concerning truthful information on price and transparent warranty policies. Furthermore, the responsibility of business actors has not fully reflected the principle of good faith, as stipulated in Article 1338(3) of the Indonesian Civil Code and Article 19 of the Consumer Protection Law, due to inconsistent and unprofessional handling of warranty claims and consumer complaints.
