Abstract

The Salafiyah Al-Muhsin Islamic Boarding School in Condongcatur, Sleman, is a traditional Islamic educational institution that emphasizes the study of yellow books and the strengthening of Islamic values through the sorogan and pengajian methods. Established in 1993, this Islamic boarding school has become a center of moral and spiritual education for students, the majority of whom are university students in Yogyakarta. This study discusses the implementation of Law Number 18 of 2019 concerning Islamic Boarding Schools on the existence and independence of the Al-Muhsin Islamic Boarding School as a non-formal educational institution that maintains the character of the Salaf amidst the changing times. The focus of this research lies in how government policies through regulations and funding, including the existence of the Islamic Boarding School Endowment Fund, impact the independence of Islamic boarding schools in carrying out their functions of education, da'wah, and community empowerment. This research is normative-empirical. It uses an empirical-juridical and sociological approach, which is an approach taken to determine the extent to which a law can be implemented in reality (law in action). This research is descriptive-analytical in nature, explaining a problem based on descriptions of the research location, namely the Salafiyyah Al Muhsin Islamic Boarding School in Codongcatur, Depok, Sleman. The author used methods such as interviews, observation, case analysis, and a literature review to collect data. The results of the study indicate that Law Number 18 of 2019 has had a positive impact on strengthening the role of Islamic boarding schools (pesantren) in the national education system. This regulation not only strengthens the legitimacy of Islamic boarding schools as educational and da'wah institutions, but also opens up opportunities for sustainable economic and social development. Although implementation has generally gone well, several obstacles remain, including limited administrative apparatus resources, a lack of technical understanding of the new regulations, and a lack of facilities and infrastructure to support government programs. From the perspective of fiqh siyasah with a maslahah mursalah approach, the Islamic boarding school law provides benefits to the community, especially in terms of hifz al din, hifz al 'aql and hifz al mal. The implementation of the Islamic Boarding School Law at the Al-Muhsin Islamic Boarding School, Condongcatur, Depok, Sleman, has thus provided real benefits to the community and is evidence of the harmony between government policies and Islamic values embedded in the Islamic boarding school environment.
