Abstract

The practice of debt and lending with an interest system has been prohibited in the Quran as a form of usury, yet this practice continues among the community, especially in P Village. Traditions in P Village that drive urgent financial needs make the presence of these no-name bank practices an instant solution. The aim of this study is to identify and explain the factors that encourage people to continue taking debt through no-name banks and to look at these traditions through the perspective of Islamic legal sociology. This type of research is field research; it is descriptive qualitative research with a juridical-empirical approach. The data collection techniques used include observation, interviews, and documentation, which are then analyzed using Islamic legal sociology so that the research is systematically organized and conclusions can be drawn and comprehensive. According to Islamic legal sociology, the results of this study indicate that the community of P Village is a society with mechanical solidarity, where there is an external force that makes the community adhere to shared norms, and social sanctions will be imposed on those who refuse. Traditions become 'urf fasid due to value shifts that lead to the prevalence of illegal banking practices, such as no-name banks, which cause more harm than benefit. Therefore, social revitalization is needed based on Islamic legal sociology.
