Abstract

Copyright, as a part of intellectual property rights, plays an essential role in providing legal protection for creators over their intellectual works and ensuring moral recognition of their authorship. Case Number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jakarta Pusat between Arie Sapta Hernawan (Ari Bias) and Agnes Monica (Agnez Mo) serves as a concrete example of copyright infringement in Indonesia, involving the unauthorized use of the song “Bilang Saja” in three commercial concerts held in Surabaya, Jakarta, and Bandung. This case is significant because the plaintiff adheres to a direct licensing system, in which permission for the use of the song must be obtained directly from the creator without involving any intermediary organization. This study employs a normative legal research method through library research by examining statutory regulations, legal theories, and copyright principles relevant to the infringement of the song “Bilang Saja” as reflected in Decision Number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jakarta Pusat. The data sources consist of primary legal materials such as legislation and court decisions, secondary materials including books, journals, and scholarly articles on copyright, and tertiary materials such as legal dictionaries to clarify legal terminology. Data collection techniques include literature review and document analysis, which aim to obtain a systematic understanding of the application of legal norms, judicial reasoning, and the mechanism of copyright enforcement in the dispute. The results of the study indicate that, first, Decision Number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jakarta Pusat provides strong legal protection for Ari Bias as the creator of “Bilang Saja” through the recognition of copyright infringement, the award of Rp1.5 billion in economic damages, the affirmation of direct licensing as an exclusive right of the creator, and the imposition of court fees on the infringing party, although protection of moral rights remains suboptimal due to the court’s rejection of damages for the omission of the creator’s name. Second, the judicial considerations demonstrate that the principle of justice is applied in a relatively progressive manner through the acknowledgment of infringement, the granting of compensation, and the rejection of the error in persona objection, although weaknesses persist, particularly the absence of moral rights compensation and the lack of direct accountability imposed on the concert organizers who bear legal responsibility for licensing and royalty obligations, indicating the need for more comprehensive enforcement of copyright law.
