Abstract

Land disputes arising from double land certificates represent one of the most persistent agrarian issues in Indonesia, including in Sumbawa Regency. Double certification typically emerges due to administrative errors, inadequate supervision, limited transparency in land data, and irregularities within the land registration process. These conditions create legal uncertainty for landholders, trigger social and administrative conflicts, and hinder the optimal utilization of land for economic and public purposes. The disputes occurring in the Samota region illustrate how overlapping certificates can escalate into prolonged conflicts, highlighting the need for a comprehensive legal analysis to understand the root causes and identify effective solutions. This study employs an empirical legal research method with a juridicalempirical approach. Primary data were obtained through interviews with officials from the National Land Agency (BPN) of Sumbawa Regency, notaries, and community members directly involved in double certificate disputes. Secondary data were collected through a literature review of statutory regulations, academic journals, and legal literature on agrarian law. The collected data were analyzed qualitatively by comparing empirical findings with applicable legal norms and evaluating the effectiveness of existing dispute resolution mechanisms. The results of this research indicate that the resolution of double land certificate disputes in Sumbawa Regency is primarily conducted through mediation facilitated by the BPN, and through litigation when mediation fails. The main contributing factors to the emergence of double certificates include mapping inaccuracies, weak document verification, lack of public awareness, and the presence of land brokers or land mafia practices. This study recommends strengthening the digitalization of land registration systems, enhancing the competence of land administration personnel, improving verification procedures for physical and juridical data, and expanding public access to land information. Furthermore, periodic monitoring and stronger coordination among local governments, BPN, and law enforcement agencies are essential to ensure legal certainty and adequate protection for landowners.
