Abstract

The increasing divorce rate in Indonesia prompted the Supreme Court to issue Circular Letter No. 3 of 2023, which emphasizes the principle of restricting divorce by requiring a minimum separation period of six months, except in cases involving domestic violence (KDRT). However, in practice, several rulings at the Wates Religious Court granted divorces even when this requirement was not fulfilled. This condition indicates variations in interpretation and the level of judicial compliance with the circular. This research aims to examine the extent of judges’ compliance with Supreme Court Circular Letter No. 3 of 2023 at the Wates Religious Court and to identify the factors influencing decisions that deviate from the provisions of the circular. This study employs a qualitative method with a juridical-empirical approach. Primary data were collected through interviews with four judges at the Wates Religious Court, while secondary data consisted of court decisions, legal literature, and related legislation. The analysis applies the theory of judicial independence, which asserts that judges have the autonomy to interpret laws and render decisions free from external influence, yet within the framework of justice and legal norms. This theory serves to explain the relationship between compliance with the circular and the exercise of judicial independence in divorce rulings. The findings reveal that judges at the Wates Religious Court generally regard Circular Letter No. 3 of 2023 as a form of substantive rather than procedural law, thus not strictly binding. Consequently, the application of the circular varies according to the context and the principle of expediency. Some judges granted divorce petitions even when the six-month separation requirement was unmet, citing strong logical reasons such as deep marital disharmony or severe economic conflict. Therefore, the level of judicial compliance with the circular is relative and influenced by judicial independence, the pursuit of justice, and the factual circumstances of each case.
